FAPE

What is Free Appropriate Public Education (FAPE)? FAPE is part of the requirements under Section 504 of the Rehabilitation Act and part of IDEA. All school aged students with disabilities are entitled to a free
appropriate public education. Section 504 defines disability as “any person who (i) has a physical or mental impairment which substantially limits one or more major life activities, (ii) has a record of such an impairment, or (iii) is regarded as having such an impairment.”

Section 504 also defines free and appropriate education. Free means no feeswill be charged to the parent for the cost of education. Appropriate education is defined as education services designed to meet the individual needs of students with disabilities as adequately as the needs of nondisabled students are met. The education takes place in an environment with nondisabled peers as appropriate.

Evaluation and placement procedures are in place to guard against misclassification or inappropriate placement of the child. FAPE also puts in place procedures for due process which allows parents to receive notices about their child’s education, review their child’s records and be able to challenge decisions about the evaluation, identification and placement.
